These terms and conditions (the "Terms") are the terms on which this website (the "Website") is made available to you. By accessing this Website You agree to be bound by these Terms.

1. GENERAL INFORMATION

1.1 ZeroEmissionProject.com is an unincorporated organization based in London, England, United Kingdom. ZeroEmissionProject.com is run by myself, Lorenzo Polidori ("I"/"Me"/"Myself").

1.2 If You have any questions, complaints or comments on this Website then You may contact Me using the contact form.

1.3 If You register to use the Website then You are responsible for maintaining the confidentiality of Your password and user name and are responsible for all activities that are carried out under them. I do not have the means to check the identities of people using the Website and will not be liable where Your password or user name is used by someone else.

2. COPYRIGHT/COPYRIGHT LICENCE

2.1 I (or my partners or licensors) own all intellectual property rights in the Website and its contents including, without limitation, trademarks, logos, graphics, photographs, animations, videos and text.

2.2 Some materials on the Website are made freely available to download and use. Such materials will be clearly marked. If you want to use any other materials or content from the Website, just get in touch. Otherwise, You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the services, web pages or materials on the Website or the computer codes of elements comprising the Website other than for Your own personal use. Subject to the above, You may download insubstantial excerpts of this content to Your hard disk for the purpose of viewing it provided that no more than one copy of any information is made.

2.3 If you submit information, text, photos, graphics or other content to Me or the Website, You grant Me a right to use such materials at My own discretion including, without limitation, to edit, copy, reproduce, print, disclose, post and remove such materials from the Website. You confirm that in relation to any material submitted to Me or posted on the Website You have the right to do so and have obtained all necessary licences and or approvals. Personal data which you post is subject to the terms of Privacy Policy.

3. LINKS TO AND FROM OTHER WEBSITES

3.1 I am happy for you to link to My Website but request that You do not remove or obscure advertisements, the copyright notice or other notices on the Website and that you stop providing links to the Website if notified by Me.

3.2 I may provide links to other websites from time to time. These links are provided for Your ease of reference and convenience only and I do not control such third party websites and I am not responsible for their contents. My inclusion of links does not imply any endorsement of the material contained in such websites or any association with their operators. You acknowledge that I will not be party to any transaction or contract with a third party that You may enter into and I shall not be liable to You in respect of any loss or damage which You may suffer by using those websites.

4. YOUR USE OF THE WEBSITE/ VISITOR MATERIAL AND CONDUCT

4.1 You agree that in using the Website You will not:

4.1.1 use the Website in any way that may lead to the encouragement, procurement or carrying out of any criminal activity;

4.1.2 email, transmit or otherwise disseminate any content which is defamatory, obscene, in breach of copyright, vulgar or indecent or may have the effect of being harassing; threatening, abusive or hateful or that otherwise degrades or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability;

4.1.3 advertise or promote third party or Your own products or services including by way of the distribution of 'spam' email;

4.1.4 transfer files that contain viruses, trojans or other harmful programs;

4.1.5 access or attempt to access the accounts of other users or to penetrate or attempt to penetrate the Website security measures.

4.2 I reserve the right to suspend, restrict or terminate Your access to this Website at any time without notice at My discretion if I have reasonable grounds to believe You have breached any of the restrictions above.

5. GENERAL

5.1 Nothing in these Terms shall exclude or limit My liability for fraudulent misrepresentation or for death or personal injury resulting from My negligence.

5.2 I do not accept any liability for damage to Your computer system or loss of data that results from Your use of the Website and I cannot guarantee that any files that You download are free from viruses, contamination or destructive features.

5.3 Whilst I use all reasonable endeavours to correct any errors or omissions as soon as practicable once they have been brought to My attention, I do not promise that the information on the Website itself will be free from errors or omissions. I also do not promise that the Website will be available uninterrupted and in a fully operating condition.

5.4 All content and services on the Website are provided on an 'as is' and 'as available' basis. I do not make any representation or give any promise (whether express or implied) in respect of the Website or its content, including, without limitation, any advice given (on a personal or general basis) and statements made by partner organisations on or via the Website. Any decisions or action taken by You on the basis of information provided on or via the website are at Your sole discretion and risk and You should obtain individual professional advice where necessary. Nothing in this clause shall restrict Your statutory rights (including Your rights to receive a reasonable standard of service).

5.5 My liability in tort, contract, negligence, pre-contract or other representations or otherwise arising out of or in connection with and/or these Terms shall be limited in aggregate to five hundred pounds.

5.6 If any provision of these Terms is found by a court or a regulator to be invalid or unenforceable the other provisions shall continue to apply.

5.7 In the event of any dispute between You and Myself concerning these Terms, relevant United Kingdom law will apply. If You wish to take court proceedings against Me You must do so within the United Kingdom.

Privacy policy

ZeroEmissionProject.com is the organisation responsible for running the Zero Emission Project ("Project"). ZeroEmissionProject.com is run by myself, Lorenzo Polidori ("I"/"Me"/"Myself"). I take your privacy rights very seriously and this privacy policy ("Privacy Policy") explains in simple terms how certain information about you may be processed.

1 YOUR DATA

1.1 "Your Data" means any information about you from which you may be personally identified including your name, address, email address and any other information from which you can be identified and which you may disclose to me on my website, in conjunction with the Project or otherwise at any time.

2 WHEN DO I COLLECT YOUR DATA?

2.1 I collect Your Data from you when you:

2.1.1 sign up to participate in, support, or receive information about the Project, whether through my website, sign-up cards or sheets, or via my partners;

2.1.2 choose to post Your Data when using any blogs or forums through my website;

2.1.3 make a complaint or enquiry or provide other feedback to me; or

2.1.4 otherwise disclose Your Data to me through the website or otherwise at any time.

3 HOW DO I USE YOUR DATA?

3.1 I use Your Data to:

3.1.1 publicise you as a participant in the Project on the website, but only where you have agreed to this;

3.1.2 monitor, develop, run and improve the website and the Project;

3.1.3 process any requests from you to participate in, support, or receive information about the project;

3.1.4 send you information by email about the Project;

3.1.5 in accordance with your marketing preferences, pass Your Data to third parties for environmental marketing purposes as set out in section 4 below;

3.1.6 process and deal with any complaints or enquiries made by or about you; and

3.1.7 monitor and investigate any suspected breach by you (or otherwise relating to you) of this Privacy Policy or terms and conditions relating to the website or Project.

3.2 According to what stated in clause 3.1, as a data controller I am exempt from notifying and registering with the Information Commissioner's Office at www.ico.gov.uk. This is because the only data processing I carry out is for advertising, marketing, public relations, accounts and records (www.ico.gov.uk/notify/self/question9.html).

3.3 You can change your mind and choose not to receive communications by me at any time by sending a message through the contact form with the text 'unsubscribe'.

4 WILL I PASS ON YOUR DATA TO THIRD PARTIES?

4.1 I will never sell or pass on Your Data to third parties for marketing purposes without your consent. I only pass on Your Data to third parties as follows:

4.1.1 I may pass Your Data to my employees, agents, subcontractors, and partner organisations to help administer the Project and provide relevant information to you;

4.1.2 Your Data may be transferred to a successor company or other organisation in the event of a sale or insolvency administration; (but you will be notified and offered the chance to unsubscribe if this occurs);

4.1.3 in some cases I may use a technical partner to conduct some processing of Your Data on my behalf, but this is always subject to strict contractual control and in compliance with UK data protection legislation;

4.1.4 only if you have given your consent for such purpose, I pass Your Data to third parties so that they can send you information which may be of interest to you; and

4.1.5 in exceptional circumstances I may need to disclose Your Data to the police, regulatory bodies or legal advisers in connection with any alleged criminal offence or suspected breach by you (or otherwise relating to you) of this Privacy Policy or any terms and conditions or pursuant to a court order.

4.2 In addition, some general statistical information about my user base may be passed on to reputable third parties for research purposes but these details will never include information personally identifying you.

4.3 Remember that if you are using a blog or forum on my website, any information about you which you choose to post will be available for others to see and I can't control how they may use it. Please therefore exercise real caution and think carefully before posting any personal information. Likewise, I require that you don't post any personal information about other people without first obtaining their express consent to do so.

5 DATA SECURITY, LINKS AND INTERNATIONAL TRANSFERS

5.1 I will take all reasonable steps to protect Your Data. All the Data collected by me is stored on a secure server.

5.2 Please act with caution when using blogs and forums as set out in 4.3 above.

5.3 Please be aware that my website may link to other web sites which may be accessed by you. I am not responsible for the privacy policies, content or security of those linked web sites.

5.4 My website is hosted externally in the United States so this means that your data will be held in the US on those servers. I don't make any other transfers of Your Data outside of the European Economic Area other than where I have measures in place to protect and continue to control Your Data and keep it secure.

6 COOKIES

Cookies are small pieces of information stored by your browser on your computer's hard drive. I use cookies to allow me to understand who has seen which pages and advertisements, to determine how frequently particular pages are visited and to determine the most popular areas of my website. Most web browsers automatically accept cookies, though you do not have to. I do not control the use of cookies by third parties.
